Visa Reservation Priority Processing
Visa Reservation:
The annual quota for EB-5 is around 10,000. The new policy provides visa reservations of 20% for rural areas, 10% for high-unemployment areas, and 2% for infrastructure projects. Among these, rural area projects are given priority in processing.
If the reserved visas are not used up within the year, they will continue to be reserved in the following fiscal year.
New Policy Review: Applications submitted under the new law receive priority processing and are not affected by backlogs. Currently, all three categories of reserved visa projects are exempt from scheduling delays, meaning that applicants under the new policy do not have to endure long waiting periods.
Benefits of concurrent filing of I-526 and I-485 for EB-5 investors
Once the I-485 application is filed, you can remain in the US while the application is pending. However, you must maintain your non-immigrant status until your application is approved. If your non-immigrant status expires while your I-485 is pending, you may need to leave the US and wait for your application to be processed from your home country.
After you file the I-485 application, the work authorization will allow you to work in the US, and the travel authorization will allow you to travel outside of the US and return while your application is pending.
